Blog No. 11: Grounds for enlarging on Anticipatory Bail

In Blog No. 1 & 2, we discussed about types of Bail and grounds to release a person on Regular Bail. In this Blog, we are discussing about Grounds to release a person on Anticipatory Bail.

Hon’ble Supreme Court inย ๐™Ž๐™ž๐™™๐™™๐™๐™–๐™ง๐™–๐™ข ๐™Ž๐™–๐™ฉ๐™ฉ๐™ก๐™ž๐™ฃ๐™œ๐™–๐™ฅ๐™ฅ๐™– ๐™ˆ๐™๐™š๐™ฉ๐™ง๐™š ๐™ซ. ๐™Ž๐™ฉ๐™–๐™ฉ๐™š ๐™ค๐™› ๐™ˆ๐™–๐™๐™–๐™ง๐™–๐™จ๐™๐™ฉ๐™ง๐™– reported as (2011) 1 SCC 694ย held that in a case where the Court is of a considered view that the ๐™–๐™˜๐™˜๐™ช๐™จ๐™š๐™™ ๐™๐™–๐™จ ๐™Ÿ๐™ค๐™ž๐™ฃ๐™š๐™™ ๐™ฉ๐™๐™š ๐™ž๐™ฃ๐™ซ๐™š๐™จ๐™ฉ๐™ž๐™œ๐™–๐™ฉ๐™ž๐™ค๐™ฃ and he is ๐™›๐™ช๐™ก๐™ก๐™ฎ ๐™˜๐™ค๐™ค๐™ฅ๐™š๐™ง๐™–๐™ฉ๐™ž๐™ฃ๐™œ ๐™ฌ๐™ž๐™ฉ๐™ ๐™ฉ๐™๐™š ๐™ž๐™ฃ๐™ซ๐™š๐™จ๐™ฉ๐™ž๐™œ๐™–๐™ฉ๐™ž๐™ฃ๐™œ ๐™–๐™œ๐™š๐™ฃ๐™˜๐™ฎ and is ๐™ฃ๐™ค๐™ฉ ๐™ก๐™ž๐™ ๐™š๐™ก๐™ฎ ๐™ฉ๐™ค ๐™–๐™—๐™จ๐™˜๐™ค๐™ฃ๐™™, in that event, custodial interrogation should be avoided, and anticipatory bail should be granted. Following factors and parameters are to be taken into consideration while dealing with the anticipatory bail:

  1. The ๐™ฃ๐™–๐™ฉ๐™ช๐™ง๐™š ๐™–๐™ฃ๐™™ ๐™œ๐™ง๐™–๐™ซ๐™ž๐™ฉ๐™ฎ ๐™ค๐™› ๐™ฉ๐™๐™š ๐™–๐™˜๐™˜๐™ช๐™จ๐™–๐™ฉ๐™ž๐™ค๐™ฃ and the exact role of the accused:
  2. The ๐™–๐™ฃ๐™ฉ๐™š๐™˜๐™š๐™™๐™š๐™ฃ๐™ฉ๐™จ ๐™ค๐™› ๐™ฉ๐™๐™š ๐™–๐™ฅ๐™ฅ๐™ก๐™ž๐™˜๐™–๐™ฃ๐™ฉ including the fact as to whether the accused has previously undergone imprisonment on conviction by a Court in respect of any cognizable offence;
  3. The possibility of the applicant to flee from justice;
  4. The possibility of the accused’s ๐™ก๐™ž๐™ ๐™š๐™ก๐™ž๐™๐™ค๐™ค๐™™ ๐™ฉ๐™ค ๐™ง๐™š๐™ฅ๐™š๐™–๐™ฉ similar or the other offences.
  5. Where the accusations have been made only with the ๐™ค๐™—๐™Ÿ๐™š๐™˜๐™ฉ ๐™ค๐™› ๐™ž๐™ฃ๐™Ÿ๐™ช๐™ง๐™ž๐™ฃ๐™œ ๐™ค๐™ง ๐™๐™ช๐™ข๐™ž๐™ก๐™ž๐™–๐™ฉ๐™ž๐™ฃ๐™œ the applicant by arresting him or her.
  6. ๐™ž๐™ข๐™ฅ๐™–๐™˜๐™ฉ of grant of anticipatory bail particularly in cases of large magnitude affecting a very large number of people.
  7. The courts must evaluate the entire available material against the accused very carefully. The court must also clearly comprehend the exact role of the accused in the case. The cases in which accused is implicated with the help of sections 34 149 of the Penal Code, 1860, the court should consider with even greater care & caution because over implication in the cases is a matter of common knowledge and concern.
  8. While considering the prayer for grant of anticipatory bail , a ๐™—๐™–๐™ก๐™–๐™ฃ๐™˜๐™š ๐™๐™–๐™จ ๐™ฉ๐™ค ๐™—๐™š ๐™จ๐™ฉ๐™ง๐™ช๐™˜๐™  ๐™—๐™š๐™ฉ๐™ฌ๐™š๐™š๐™ฃ ๐™ฉ๐™ฌ๐™ค ๐™›๐™–๐™˜๐™ฉ๐™ค๐™ง๐™จ namely, no prejudice should be caused to the free, fair and full investigation and there should be prevention of harassment, humiliation & unjustified detention of the accused;
  9. The court to consider reasonable apprehension of ๐™ฉ๐™–๐™ข๐™ฅ๐™š๐™ง๐™ž๐™ฃ๐™œ ๐™ค๐™› ๐™ฉ๐™๐™š ๐™ฌ๐™ž๐™ฉ๐™ฃ๐™š๐™จ๐™จ…..;

Frivolity in prosecution should always be considered and it is only the element of genuineness that shall have to be considered in the matter of grant of bail and in the event of there being some ๐™™๐™ค๐™ช๐™—๐™ฉ ๐™–๐™จ ๐™ฉ๐™ค ๐™ฉ๐™๐™š ๐™œ๐™š๐™ฃ๐™ช๐™ž๐™ฃ๐™š๐™ฃ๐™š๐™จ๐™จ ๐™ค๐™› ๐™ฉ๐™๐™š ๐™ฅ๐™ง๐™ค๐™จ๐™š๐™˜๐™ช๐™ฉ๐™ž๐™ค๐™ฃ, in the normal course of events, the accused is entitled to an order of bail.โ€
